Approve Minutes from last meeting

In the matter of approving the Minutes from the February 16, 2021 Business Meeting. - BOCC

Background: Approve the Minutes which summarize all business by the Board of Commissioners for the Business Meeting held on the date stated above.

Fiscal Impact: None

Recommended Motion: Approve the Minutes as presented.

Budget Resolutions

1.

In the Matter of the Adoption of a Budget Resolution within the General Fund, Non-Departmental, Assessor, Tax Collector, Clerk, Commissioner, District Attorney, Justice Court, Sheriff and Juvenile Departments, and, Community Corrections Fund, Road Fund, Solid Waste Fund, Public Health Fund, Mental Health Fund, Veterans Fund, Museum Fund, Parks Fund, Fairgrounds Fund, Community Development Fund, Internal Service Fund, Non-Departmental, General Administration, Human Resources, Counsel, Finance and Information Technology Departments, and Facility Services Fund. Vickie Noel - Finance

Background:   The County participates in a credit card rebate program. The Board of Commissioners by policy has chosen to allocate the rebates earned by departments back to them through reduced internal service fee allocations in the subsequent year’s budget. The amount of the rebate earned by Klamath County during the 2020 fiscal year is $53,477.00.

Fiscal Impact:   Fiscal impact will decrease revenues and expenditures in the General Fund of $6,356.00 and the Internal Service Fund of $16,943.00. The following funds do not have a fiscal impact, however expenditure category are changed; Justice Court, $70.00; Community Corrections Fund, $4,078.00; Road Fund, $1,065.00; Public Health Fund, $2,590.00; Mental Health Fund, $2,345.00; Veterans Fund, $315.00; Museum Fund, $838.00; Parks Fund, $322.00; Solid Waste Fund, $4,922.00; Fairgrounds Fund, $6,764.00; Community Development Fund, $3,900.00; and Facility Services Fund, $2,969.00.
 
Recommended Motion: The Board of Commissioners of Klamath County, Oregon hereby approve the budget resolution for fiscal year 2020-2021 as outlined in the attached documents for changes to all departments participating in the credit card rebate program.  Fiscal impacts as stated above.

Orders

1.

In the matter of Klamath County Transient Room Tax fourth quarter distribution, ending December 31, 2020. Rick Vaughn- Tax Collector

Background:  In accordance with Klamath County Code Chapter 603-Transient Room Tax any person, firm, social club, etc., who exercises occupancy for thirty days or less for dwelling, lodging, or sleeping purposes from any hotel, motel, space in mobile home or trailer park, etc. from an operator; shall collect the tax imposed which constitutes a debt owed by the operator to the County.  The amount collected for the fourth quarter came to $489,197.73 and shall be distributed accordingly by the tax revenue sharing formula to the Participants.

Fiscal Impact: TRT revenue will be distributed totaling $484,305.75 with additional $4,891.98 revenue to the Tax Collector’s Office.  Expenditure of $489,197.73 to the Transient Room Tax Fund, Tax Collector Department.

Recommended Motion:  Approve and execute the attached Order so the Tax Administrator can distribute accordingly by the tax revenue sharing formula $489,197.73 to the Participants of the Transient Room Tax set by Klamath County Code 603.610.  Fiscal impact being revenue received and distributed in the amount of $489,197.73. Expenditure of $489,197.73 to the Transient Room Tax Fund, Tax Collector Department.

2.

In the matter of appointing Ryan Hartman to the Predatory Animal Control District Board. - BOCC

Background: The Predatory Animal Control District Board has a vacancy and has recommended the appointment of the above named applicant who is willing, able and eligible to serve a term on the Board commencing this day and continuing until December 31, 2023

Fiscal Impact: None.

Recommended Motion: Approve and sign the attached Order appointing Ryan Hartman to the Predatory Animal Control District Board.

7.

Agreements

1.

In the matter of an agreement between Klamath County and U.S. Department of Fish & Wildlife for noxious weed control. Todd Pfeiffer, Weed Control

Background: Klamath County enters into agreements with outside agencies to treat noxious weed infestations on their property.  The purpose of this agreement is to treat noxious weed-infested areas of fish & Wildlife ownership within Klamath County.  The location of the treatment is as follows:

a.  Lower Klamath National Wildlife Refuge
b.  Bear Valley National Wildlife Refuge

Fiscal Impact:  Income of $2,500.00 to the Weed Control Budget.

Recommended Motion:  Board approve and sign the agreement between U.S. Department of Fish & Wildlife and Klamath County for noxious weed control.  Fiscal Impact is $2,500.00 income to the Weed Control Budget.

Issue: In the matter of an agreement between Klamath County and Weyerhaeuser NR Company for noxious weed control. Todd Pfeiffer, Weed Control

Background: Klamath County enters into agreements with outside agencies to treat noxious weed infestations on their property.  The purpose of this agreement is to treat noxious weed-infested areas of Weyerhaeuser ownership within Klamath County.  The location of the treatment is as follows:

Sycan Shop Tax Lot# R-3612-00000-04600-000
Bly Landfill Tax Lot# R-3714-00200-00300-000

Fiscal Impact:  Income of $4,000.00 to the Weed Control Budget.

Recommended Motion:  Board approve and sign the agreement between Weyerhaeuser NR Company and Klamath County for noxious weed control.  Fiscal Impact is $4,000.00 income to the Weed Control Budget.
3.

In the matter of the approving the contract with Great Basin Insurance for the Insurance Agent of Record (AOR) Services. Leslie Barlow-Hunter-Contracts/Risk Management & County Counsel

Background: Risk Management/County Counsel issued a Request for Proposal (RFP) to request proposals from qualified agents to provide Insurance Agent of Record Services to Klamath County.  Great Basin Insurance proposal was accepted by the Board on January 19, 2021. The contract is effective for a five-year term with two additional one-year term options.

Fiscal Impact: $49,660.00 annually for a five-year total of $248,300.00 to the Risk Management budget.

Recommended Motion: Motion to approve and sign the contract from Great Basin Insurance to provide Klamath County with Insurance Agent of Record Services. Fiscal impact of $49,660.00 annually for a five-year total of $248,300.00 to the Risk Management budget.

In the matter of the approving the Master Service Agreement and Scope of Work between Klamath County, Clark Hill PLC and Crypsis to provide professional services as directed to assist in the response to a security incident. Leslie Barlow-Hunter/Risk Management

Background: Klamath County was made aware of an email data breach that occurred on February 2, 2021. These services, referred to us by our cyber liability company, help in the investigation and determination of the severity and next steps for this breach.

Fiscal Impact: Not to exceed the deductible amount of $5,000.00 to the Risk Management budget.

Recommended Motion: Motion to approve and authorize the Chair to sign the Master Service Agreement and Scope of Work between Klamath County, Clark Hill PLC and Crypsis to provide professional services as directed to assist in the response to a security incident. Fiscal impact not to exceed the deductible amount of $5,000.00 to the Risk Management budget.

Licenses

1.

In the matter of approval of a Social Gaming License for Mohawk Restaurant and Lounge for one (1) card table. - BOCC

Background: The Klamath County Ordinance 21.1 allows for Social Gaming License by firms, persons, or corporations doing business for profit.  Each new application is reviewed by the Klamath County Sheriff’s Office.  The Sheriff has recommended this Social Gaming License be granted.  No house income may result from the operation of these social games. 

Fiscal Impact: Revenue of $100.00 ($100.00 per table) to the General Fund Commissioners.

Recommended Motion:  Approve the Social Gaming License for Mohawk Restaurant and Lounge for one (1) card table and authorize the Chair to sign the approval form. The fiscal impact is revenue of $100.00 to the General Fund Commissioners.

Library Service District

1.

Adopt a Budget Resolution within the General Fund of the Library Service District. Vickie Noel - Finance

Background:  The County participates in a credit card rebate program.  The Board of Commissioners by policy have chosen to allocate the rebates earned by departments back to them through reduced internal service fee allocations in the subsequent year’s budget.  The amount of the rebate earned by Klamath County applicable to the Library District during the 2020 fiscal year is $8,784.00.

Fiscal Impact:  No fiscal impact, but a change in expenditure category of $8,784.00.

Recommended Motion:  Approve the budget resolution for fiscal year 2020-21 as outlined in the attached document for changes to the Library Service District General Fund.  There is no fiscal impact, but a change in the expenditure category of $8,784.00.
