Background: Pursuant to ORS 312.122 a public hearing must be held regarding the acceleration of tax foreclosed properties. Today’s Public Hearing was advertised in the Herald and News on January 2nd, 2021 and again on January 16th, 2021. Background: Pursuant to ORS 312.122 a public hearing was held on January 26th 2021, at 8:45am to take public comment regarding the acceleration of tax foreclosed properties. TIME CERTAIN 8:45 am - In the matter of holding the second Public Hearing to take public comment regarding finalizing Phase One/Design and Engineering for the Bly Water and Sanitary District's Community Development Block Grant Project. - BOCC

Background: Klamath County received a Community Development Block Grant from the Business Oregon for Bly Water and Sanitary District's Sewer Project. The purpose of the project was to design the replacement of the municipal water supply distribution system. It is estimated that the project has benefitted at least 214 persons of whom 57.48% are low or moderate income. This 2nd public hearing is for the BOCC to obtain citizen views about the project and to take comment about the local government’s performance.

Fiscal Impact: $280.91 Expenditure for publication notice, General Fund Commissioners Grants Line Item

TIME CERTAIN 8:50 am - In the matter of holding a Public Hearing to take public comment regarding an application for a Community Development Block Grant. - BOCC

Background: Klamath County is preparing an application for a 2021 Community Development Block Grant from Business Oregon for the Bly Water and Sanitary District’s Drinking Water Distribution Line Replacement Project. The construction project consists of the replacement of approximately 12,460 lineal feet of distribution line and associated valves and service connections. The replacement of the drinking water distribution lines will provide more reliable water delivery to the community’s residents. It is estimated that the proposed project will benefit at least 214 persons, of whom 57.48% will be low or moderate income. The purpose of this hearing is for the Board of County Commissioners to obtain citizen views and to respond to questions and comments about: community development and housing needs, especially the needs of low- and moderate- income persons, as well as other needs in the community that might be assisted with a Community Development Block Grant project; and the proposed project.

Fiscal Impact: $487.37 Expenditure for publication notice, General Fund Commissioners Grants Line Item

Bids/Awards/Proposals

1.

In the matter of accepting the quote from Freightliner Northwest for One (1) New Freightliner Truck. Jeremy Morris, Public Works

Background:  Klamath County Public Works would like to utilize Klamath County’s membership in the ORCPP program to purchase One (1) New Freightliner Truck off of DES contract #01513.  Members of the Oregon Cooperative Procurement Program are eligible to use Washington State Master Contracts.

Fiscal Impact:  $232,916.00 expenditure to the Road Department Equipment Reserve Budget.

Recommended Motion:  Board to accept and authorize chair to sign the quote from Freightliner Northwest for One (1) New Freightliner Truck and authorize Public Works to issue a Purchase Order.  Fiscal Impact is $232,916.00 expenditure to the Road Department Equipment Reserve Budget.

Orders

1.

In the matter of executing an order adding Wyoming Street and a portion of Hager Lane to the Winter Level of Service Maintenance program. Jeremy Morris, Public Works

Background:  On December 8, 2020 the Board of County Commissioners adopted the Revised Winter Level of Service for County Roads.  Wyoming Street and a portion of Hager Lane were added to the County Road Maintenance program as Class “B” and Class “E” roads.  This order adopts the amended Winter Level of Service for County Roads to include the portions of Wyoming Street and Hager Lane to be maintained as “E2” and “B” accordingly. 

Fiscal Impact:  None

Recommended Motion:  Board approve and execute the order adding Wyoming Street and a portion of Hager Lane to the Winter Level of Service Maintenance program.  Fiscal Impact is none.

Agreements

1.

Issue: In the matter of Approval of Amendment #16 to Agreement #159817 Intergovernmental Agreement (IGA) for the provision of Environmental Health Services between the State of Oregon, Oregon Health Authority (OHA), and Klamath County Public Health (KCPH). – Jennifer Little, Director

Background:  Amendment 16 updates the Financial Assistance Award from FY 20 to remove unspent federal funding of $17,492 from the WIC award. This unspent funding is the result of shift in staff resources to support the COVID pandemic response. It is standard practice for  Oregon Health Authority to deobligate funds in closing out each fiscal year. The award period impacted under this funding award was from July 1, 2019 to June 30, 2020. This update is for record keeping purposes for Oregon Health Authority only. 


Fiscal Impact:  There is no fiscal impact for the amendment. The agreement is updated to reflect that $17,492 in funding contained in the agreement was removed as it was not spent during the award period. 

 
Recommended Motion:  Move to approve of Amendment #16 to Agreement #159817 Intergovernmental Agreement (IGA) for the provision of Environmental Health Services between the State of Oregon, Oregon Health Authority (OHA), and Klamath County Public Health. No fiscal impact, contractual update to award amount is reduction of allocated award by $17,492. Authorize Department Head to sign.

The Klamath County Sheriff is requesting approval to enter into and sign Cooperative Law Enforcement Agreement 19-LE-11060200-006 Modification #003 with the U.S. Forest Service (USFS)- Chris Kaber Sheriff

Background: The modification is the 2021 Annual Operating Plan (AOP) which will be attached as Exhibit A to the Cooperative Law Enforcement Agreement.  It dedicates funding for law enforcement patrol services on US Forest Service land in the amount of $30,800, $40,000 for Operation Forest Watch for the 2021 calendar year and $6,686.73 of carry-over from the 2020 AOP.  The funding is provided on a reimbursement basis based on hours of service provided.  The AOP also updates the current reimbursable rates. 

Fiscal Impact:  Potential $77,486.73 revenues into the General Fund- Sheriff’s Office-Patrol Division in the 2021 calendar year. 

Recommended Motion:   To approve the Sheriff to enter into and sign the Cooperative Law Enforcement Agreement 19-LE-11060200-006 Modification #003 with the U.S. Forest Service.  Fiscal Impact is potential revenues of $77,486.73 into the General Fund-Sheriff’s Office-Patrol Division in the 2021 calendar year.

In the matter of approving an IGA between Oregon Secretary of State and Community Corrections for Electronic Records Management Services. Aaron Hartman, Community Corrections

Background: Community Corrections has been looking into ways to transition CJIS secure client files into an electronic managing system in an effort to become a paperless agency. 

The Oregon Records Management Solution (ORMS) is a statewide program that provides information management tools, training and support for public entities in Oregon. Developed to help government better manage information and records in the public trust, ORMS is the first of its kind in the nation. ORMS is a public-private partnership between the Oregon State Archives and Chaves Consulting, an Oregon based firm with a history of supporting state and local government. All public entities in Oregon can take part in ORMS through a statewide master services agreement. 

The Klamath County IT department recommended ORMS as a good solution for Community Corrections client files. The program complies with all security needs and is priced per user. Community Corrections intends to purchase licenses for all current staff members. Licenses can be added and removed as needed without amending the agreement. 

Fiscal Impact: An annual expenditure not to exceed $17,000.00 from the Community Corrections operating fund. 

Recommended Motion: Motion to approve and authorize Aaron Hartman to sign an IGA between Oregon Secretary of State and Community Corrections for Electronic Records Management Services. Fiscal Impact: An annual expenditure not to exceed $17,000.00 from the Community Corrections operating fund.
