Public Hearings

TIME CERTAIN 8:45 am - In the matter of holding a Public Hearing to take public comment regarding an application for a Community Development Block Grant. - BOCC

Background: Klamath County is preparing an application for a 2019 Community Development Block Grant from the Business Oregon for Bly Water and Sanitary District’s sewer project. The purpose of the project is to design the replacement of the municipal water supply distribution system. It is estimated that the proposed project will benefit at least 250 persons, of whom at least 51% will be low or moderate income. 


Fiscal Impact: $479.48 Expenditure for publication notice, General Fund Commissioners

In the matter of a accepting quote #165864-02 from Peterson Cat for One (1) New Caterpillar Model CS44B-BR Vibratory Compactor. Jeremy Morris, Public Works

Background:  Klamath County Public Works would like to utilize Klamath County’s membership in the Sourcewell (formerly NJPA) cooperative purchasing program by purchasing One (1) New Caterpillar Model CS44B-BR Vibratory Compactor off of Sourcewell Contract 032119-Cat.

Fiscal Impact:  $129,925.91 expenditure to the Road Department Equipment Reserve Budget

Recommended Motion:  Board to accept the quote from Peterson Cat for One (1) New Caterpillar Model CS44B-BR Vibratory Compactor and authorize Public Works to issue a Purchase Order.  Fiscal Impact is $129,925.91 expenditure from the Road Department Equipment Reserve Budget.

2.

In the matter of accepting the quote from Freightliner Northwest for One (1) New Freightliner Truck. Jeremy Morris, Public Works

Background:  Klamath County Public Works would like to utilize Klamath County’s membership in the ORCPP program to purchase One (1) New Freightliner Truck off of DES contract #01513.  Members of the Oregon Cooperative Procurement Program are eligible to use Washington State Master Contracts.

Fiscal Impact:  $246,370.00 expenditure to the Road Department Equipment Reserve Budget.

Recommended Motion:  Board to accept and authorize chair to sign the quote from Freightliner Northwest for One (1) New Freightliner Truck and authorize Public Works to issue a Purchase Order.  Fiscal Impact is $246,370.00 expenditure to the Road Department Equipment Reserve Budget.

1.

In the Matter of an Order authorizing accelerated tax foreclosure on the below properties pursuant to ORS 312.122./Rick Vaughn Tax Collector/Property Manager

Background: Pursuant to ORS 312.122 a public hearing was held on August 6, 2019 at 8:45am to take public comment regarding the acceleration of tax foreclosed properties. Public Hearing was advertised in the Herald and News on July 21, 2019 and July 28, 2019 and the notice of hearing was mailed via certified mail to the property owners and lien holders, if any, on June 27, 2019.

Properties are described as follows:

1934 Homedale Rd. Klamath Falls, OR 97603/R-3909-002AB-09100-000
5294 Peggy Ave. Klamath Falls, OR 97601/R-3908-013DA-04300-000

Fiscal Impact: None

Recommended Motion: Approve and sign attached Order authorizing acceleration of tax foreclosure on the above referenced properties. Fiscal Impact: None

Agreements

1.

In the matter of Approval of lease between Klamath County and Klamath Housing Authority for Lease of 2426 and 2428 White Ave. Klamath Falls, OR. Rick Vaughn Tax/Property Sales

Background: Klamath County wishes to enter into a lease agreement with Klamath Housing Authority (KHA) for 2426 and 2428 White Ave. Klamath Falls, OR commencing on July 1, 2019 through June 30, 2022.
KHA will pay $1.00 per year on July 15th each year for the lease.

Fiscal Impact: $1.00 per year for each of the next 3 years.


Recommended Motion: Approve and sign the lease between Klamath County and Klamath Housing Authority for 2426 and 2428 White Ave. Klamath Falls, OR commencing on July 1, 2019 through June 30, 2022. Fiscal impact will be $1.00 per year for each of the next 3 years.
2.

In the Matter of the Klamath County Sheriff requesting approval to enter into and sign Cooperative Law Enforcement Agreement 19-LE-11060200-006 Modification #001 with the U.S. Forest Service (USFS).-Chris Kaber, Sheriff.

Background: The modification would be incorporated as a supplement to the cooperative agreement and annual operating plan that is currently in place. Modification # 001 increases funding available to the Sheriff’s Office for reimbursement of expenses incurred specifically for law enforcement investigation, detection, eradication and prosecution of cannabis trafficking within National Forest System lands. The additional funding of $40,000 will be available for reimbursement upon execution of the agreement through February 28, 2024. 

Fiscal Impact: Additional funding offered on a reimbursable basis in the amount of $40,000 which will be made available through February 28, 2024. 
 
Recommended Motion:  To approve the Sheriff to enter into and sign the Cooperative Law Enforcement Agreement 19-LE-11060200-006 Modification #001 with the U.S. Forest Service which would be supplemental to the agreement and annual operating plan. It provides up to $40,000 in reimbursement funding for cannabis related law enforcement on National Forest System lands from the date the modification is executed through February 28, 2024.

Licenses

1.

In the matter of approving a recommendation for a renewal liquor license for Klamath River Gas, The Lake House, Crater Lake Resort, Crescent Shell, Sergio’s Mexican & Seafood Restaurant, Manley’s Tavern, Pilot Travel Center #133 Chemult, El Grullense Restaurant, Rick’s Smoke Shop and Gilchrist Grocery Deli. - BOCC

Background: The Oregon Liquor Control Commission (OLCC) verifies that each tavern/store has met the necessary conditions to sell liquor.  The County’s position is a recommendation only and the OLCC may take the recommendation into consideration before granting or refusing the license.

Fiscal Impact: $10.00 revenue to General Fund Commissioners for each renewal license.
